Statutory Education Specialist

Childcare Compliance
& Education Safety

Regulation 97 is not a suggestion. For childcare providers, "standard" emergency planning is a statutory breach. We provide the specialized rigour required for the Education and Care Services National Regulations.

The 2026 Statutory Mandates

Childcare centers operate under a dual-compliance framework: **AS 3745-2010** and the **Education and Care Services National Regulations**. Failure to harmonize these results in immediate Priority 1 Defects during NQS assessments.

Priority 1

Regulation 97: 3-Month Cycle

While AS 3745 suggests annual drills, Reg 97 mandates every 3 months. Anything exceeding 90 days is a direct statutory breach. We manage this schedule for you.

Statutory Breach

Worst-Case Egress Simulation

New for 2026: Drills must now simulate 'worst-case' conditions (e.g., primary exit blocked). Procedures must be explicitly aligned with the building's Fire Engineering Report (FER).

NQS Defect

Child Safe Standards Alignment

Emergency procedures must now integrate Physical and Psychological safety protocols under the 2026 NQS updates. A lack of 'Child Safe' response integration is a Defect.

Critical Defect

Multi-Storey Egress (Reg 97(1)(c))

For multi-storey facilities with no direct egress to an assembly area, procedures must demonstrate specific alignment with the building's fire engineering safeguards.

Compliance Gap

Warden Skills Retention

AS 3745 mandates Warden training every 6 months. In high-turnover childcare environments, this is the most common point of failure during audits.

New Mandate

Digital Register Verification

Aug 2026 Update: All passive fire systems and drill logs must be verifiable via digital logbooks. Paper-only records for multi-storey centers are now a Defect under Clause 1.12.

Why Compliance Ready is the Expert Choice

Sector-Specific Expertise

We don't do "general" fire safety. Our consultants are trained specifically in Regulation 97 and Child Safe Standards. We understand the logistics of evacuating 60+ infants under staff-to-child ratios.

24-Hour Recovery Service

Faced with an urgent NQS assessment or a non-compliance notice? Our Gold Service provides statutory documentation and site verification within 24 hours.

The "Defect" Standard

We apply the most rigorous statutory logic in the industry. We don't "soften" reports—we identify Defects so you can fix them before a regulator or insurer does.

The Managing Director Standard

"Managing emergency procedures for childcare isn't about ticking a box. It's about protecting children who cannot save themselves. At Compliance Ready, we treat every Regulation 97 review as a absolute statutory requirement, not an administrative task."

Jamie Illistom

Senior Consultant & Founder

All Education & Childcare assessments apply our dual-standard logic: AS 3745 Pass Verification + Regulation 97 Statutory Defect Check.

As of 2026, any NSW facility not citing **AS 1851-2012 Section 14** as their baseline for AFSS is a critical Priority 1 Defect.
