Mandatory Worst-Case Egress Simulations (Regulation 97)

Strict Statutory Requirements: 2026 Updates

As of January 1, 2026, the Education and Care Services National Regulations (Regulation 97) have been updated with stringent new requirements for emergency drills. Compliance is no longer just about frequency; it is about the depth and realism of the simulation.

  • Quarterly Minimum: Emergency drills must still be conducted at least every 3 months (Reg 97(3)). Failure to meet this frequency is a direct statutory breach.
  • Annual Worst-Case Simulation: At least once per year, centers must document a simulation of "worst-case" egress conditions. This includes simulating blocked primary exits or limited staff availability (Reg 97 2026 Update).
  • Multi-Storey Egress (Reg 97(1)(c)): For services in multi-storey buildings without direct egress to an assembly area, procedures must be explicitly aligned with the building's fire engineering report (FER).
  • Egress Variation Testing: Failure to explicitly document testing against variations (e.g., blocked stairs) now constitutes a Priority 1 Defect in compliance audits.
