Strata Fire Safety Compliance
The definitive expert guide to statutory compliance and risk mitigation for NSW Strata Schemes.
Mandatory Statutory Requirements
As of 13 February 2026, the NSW Government has mandated that all new and existing class 2 to 9 buildings must comply strictly with AS 1851-2012 for the routine service of fire protection systems. For Strata Schemes, the transition period has ended. Non-adoption of Section 14 (Six-Monthly) schedules is a Defect that may put insurance cover and WHS compliance at risk.
- Annual Fire Safety Statement (AFSS): Must now cite AS 1851-2012 as the baseline for maintenance. Any statement submitted without the requisite 6-monthly competent person reviews under Section 14 will be rejected by local councils.
- EPC Management: AS 3745 requires the establishment of an Emergency Planning Committee (EPC). Failure to document annual EPC meetings and 6-monthly Warden skills retention training is a Defect that can expose the Owners Corporation to insurance repudiation and WHS liability.
- Psychosocial Risk Assessment: Under the July 2026 WHS Code updates, Strata Committees must now account for psychosocial risks within their emergency response frameworks.
